Vznikla Mezinárodní asociace právníků pro lidská práva. Byli jsme u toho.

Právníci z deseti zemí Evropy řekli NE pandemické úmluvě WHO.

Ve dnech 30. června až 2. července 2023 se v Kolíně nad Rýnem uskutečnila 18. konference Advokátů pro osvětu, které se zúčastnilo 35 advokátů a dalších odborníků mnoha právnických profesí. Konference se za Českou republiku zúčastnil i náš kolega – člen Institutu práva a občanských svobod Pro Libertate – JUDr. Petr Vacek.

Na této konferenci byla založena i nová Mezinárodní asociace právníků pro lidská práva. Díky kolegovi Petrovi Vackovi jsme se stali jedním z jejích prvních spoluzakladatelů. Tato mezinárodní asociace umožní lepší výměnu zkušeností a zejména efektivní koordinaci advokátů a zástupců ostatních právnických profesí při společném boji proti porušování základních lidských práv a svobod.

Účastníci konference diskutovali masivní porušování lidských práv a svobod, ke kterému docházelo v minulém období tzv. pandemie covid-19. Na konferenci byla věnována mimořádná pozornost i připravované pandemické úmluvě WHO, která by v případě jejího přijetí představovala nejen zásadní hrozbu pro suverenitu jednotlivých členských států WHO, ale umožnila by i zcela bezprecedentní přímé zásahy WHO do základních lidských práv a svobod jednotlivých lidí.

Zástupci jednotlivých zemí se shodli, že je nezbytné, aby rozhodování o řešení epidemií i pandemií zůstalo v kompetenci jednotlivých států. A to i na základě neblahých zkušeností z doby tzv. covidové pandemie, kdy evropské země v mnoha směrech opustily principy demokratického právního státu, omezily některá dosud nedotknutelná základní lidská práva a dokonce zavedly diskriminaci neočkovaných lidí na úrovni, kterou Evropa nepamatuje od dob 2. světové války. Shodli se též na potřebě přijetí takových společných opatření, která by jednotlivým státům zabránila opakovat toto porušování lidských práv a svobod v budoucnosti, přičemž za klíčový krok označili zabránění přijetí tzv. pandemické úmluvy WHO a jejímu schválení v národních parlamentech členských států. Za tímto účelem zahájili práce na vypracování konkrétních metod společného postupu.      

Konference se vedle našeho zástupce zúčastnili zástupci Francie, Itálie, Izraele, Lichtenštejnska, Německa, Nizozemska, Rakouska, Španělska a Švýcarska. 

Jedním z hlavních výstupů konference bylo společné prohlášení v tomto znění:

„My, právníci, odmítáme plán návrhu pandemické úmluvy Světové zdravotnické organizace WHO a návrhy změn zdravotních opatření (tzv. IHR). Zejména vyzýváme státy Evropy, aby se neúčastnily plánů, které mají předat WHO dalekosáhlá oprávnění v budoucnu pro vyhlašování pandemií a přijímání opatření v boji proti takovým pandemiím, které by se pro členské státy staly závaznými bez možnosti zasáhnout do nich či je jakkoliv upravit na národní úrovni.“

Náš právní institut Pro Libertate otázku pandemické úmluvy podrobně sleduje. Uděláme vše pro to, aby tento dokument (ani navazující regulace) nebyl v České republice přijat, aby si Česká republika zachovala nezávislost a svrchovanost při řešení budoucích krizí. Jsme rádi, že se v tomto úsilí budeme moci opřít i o zahraničních partnery.

Otázku pandemické úmluvy budeme nadále sledovat a budeme o ní jednat i se zástupci Parlamentu České republiky. Jsme přesvědčeni, že Česká republika nesmí tuto úmluvu ani na ni navazující předpisy WHO ratifikovat.

Ladies and gentlemen, dear colleagues,

All of you here in this room probably remember President Václav Havel, the first democratically elected president after the revolution in 1989, when we succeeded in defeating the communist dictatorship.

In his New Year’s address to the nation in January 1990, he said, among other things, the following:

„Dear fellow citizens,

For forty years, on this day, you have heard the same thing from the lips of my predecessors, in various variations: how our country is flourishing, how happy we all are, how confident we are in our government and what wonderful prospects are opening up before us.

I presume that you did not put me in this office because I lied to you…..

We live in a corrupt moral environment. We are morally diseased because we have become accustomed to saying one thing and thinking another…..

When I talk about a corrupt moral climate, I am not just talking about gentlemen who eat organic vegetables and do not look out of their airplane windows. I’m talking about all of us. Because we have all become accustomed to the totalitarian system and accepted it as an immutable fact, and thus actually perpetuated it. In other words, we are all responsible, of course, to different degrees – for the operation of the totalitarian machine; we are not only its victims, but we are all also its co-creators“.

Let me paraphrase those wise words and say that you did not invite me to lie to you.

Do not be under any illusion. Recent times have clearly shown us that the totalitarianism that we in Central and Eastern Europe still remember is making a comeback. It is returning not only in the form of restrictions, prohibitions, orders and regulations, but also in the form of replacing human morality with the principle of the one and only correct opinion.  And it does not matter whether this totalitarianism is dressed in the mantle of pandemics, climate change, unlimited migration rights for anyone, woke or anything else.

Individual human rights and freedoms and dignity are described as something that must take a back seat to the interests of the whole, society and the planet.  They are progressively curtailed and passed off as individual selfishness. Nobody dares to abolish them formally yet, but they will remain on paper and real life will go the other way.

Nothing we don‘t know from the past. The constitutions of the so-called socialist states in the past were just flourished with human rights and the welfare of citizens slogans. In fact, it was a time of darkness, oppression and dictatorship, when a narrow group of „enlightened“ leaders, then communists, brutally dictated their will to the rest of society. Those who did not comply were eliminated. Legally, politically, socially and often physically. If we do not see these parallels, or deny this reality, then we are all blind, deaf and deserve o live this dark history again.  If we don’t want this, then we have one last chance.              

Our group of Czech lawyers has filed dozens and perhaps hundreds of lawsuits, complaints, criminal complaints since the beginning of the so-called pandemic. From the general courts to the Constitutional Court. We have had partial successes only in cases where the courts have upheld our objections to the improper formal procedures of the state authorities in issuing draconian regulations restricting fundamental human rights and freedoms.  In substance, i.e. as to the legitimacy and proportionality of the state power’s interference, the courts have never upheld our claims. And believe me, they will be scared as hell to do so at any time in the future.

Ladies and gentlemen, dear colleagues,

Let’s call a spade a spade.  The judiciary, one of the pillars of the state, has cowardly bowed its head to anti-human politics and become its servant. During the totalitarian era, it was taught in law schools that ‚law is the will of the ruling class elevated to the status of law‘. That time is back.

In my country  we have understood that in this situation it is impossible to defeat this hydra solely with the help of law. We have therefore founded an expert Legal Institute of Law and Citizens Freedoms „Pro Libertate“, our own trade union and the political party Law Respect Expertise, which is striving to win the next elections. We are mobilising Czech civil society. And if there is no other option, we will certainly not forget the wording of Article 23 of the Charter of Fundamental Rights and Freedoms, which is part of the Czech Constitution and says: „Citizens have the right to resist anyone who would eliminate the democratic order of human rights and fundamental freedoms established by the Charter, if the activities of constitutional bodies and the effective use of legal means are prevented“.

In this connection dare a cruel comparison, but in the opposite case, we find ourselves in the position of a lawyer writing an appeal for his client against an order to appear at a meeting place for transport to a concentration camp. We all know from history what success this procedure has had.

Yes, our professional effort as lawyers  will continue to be important. And I promise, we will do our best. But without political parties, often from political parties that are currently being ostracized and vilified, our work will be worthless. It will be without result. They will be like Václav Havel’s books, which, although written by the author, were not allowed to be published or read during the communist dictatorship.

Theme of my speach was „Recognizing authoritarian systems – Differences between East and West“. Speaking about the differences, based on my personal experience, I will answer you laconically: At the moment –  there are almost none!
